Your brand name and logo are what customers remember. Without registration, someone else could register a similar name and stop you from using your own brand. In Pakistan, trademarks are registered with the Trade Marks Registry under the Intellectual Property Organization of Pakistan (IPO-Pakistan).
What can be registered as a trademark?
- Brand or business names
- Logos and symbols
- Slogans and taglines
- Combinations of words and designs
Choosing the right class
Trademarks are registered under the Nice Classification, which divides goods and services into 45 classes. For example, clothing falls in one class while restaurant services fall in another. You need to file in every class that covers the goods or services you sell under the brand.
The registration process
- Search: check that no identical or similar mark is already registered or pending.
- Application: file the application with your mark, class and owner details.
- Examination: the Registry checks the application and may raise objections.
- Publication: once accepted, the mark is published in the Trade Marks Journal so others can oppose it.
- Registration: if there is no successful opposition, the certificate of registration is issued.
How long does it take?
Because of examination and publication, the full process usually takes several months. Once filed, you can use the ™ symbol. The ® symbol can be used only after registration. A registered trademark is valid for 10 years and can be renewed.
